GAME-CHANGER: The Impact of South Dakota v. Wayfair on Sales Tax Compliance
Since the Supreme Court of the United States overruled the physical presence restriction in its decision in South Dakota v. Wayfair, Inc., more than 30 states and the District of Columbia have adopted economic nexus policies requiring certain out-of-state sellers to collect and remit sales tax. Such requirements are already being enforced in many states, and they’re set to take effect in early 2019.
New Supreme Court changes could significantly impact your compliance process, and create audit risk. It used to be that states could only tax sales by businesses with a physical presence in the state. Now economic activity in a state — economic nexus — can trigger a sales tax collection obligation. Economic nexus is based entirely on sales revenue, transaction volume, or a combination of both.
